Exploring Plant Pathology in Insurance Investigations

James Townsend presents at CII on plant pathology

At the CII Sussex, North Downs and Guildford event, James Townsend, Senior Associate at Hawkins, delivered a presentation on the role of plant pathology in insurance investigations. Drawing on his extensive background in agricultural science and plant pathology, James explained how the study of plant diseases, disorders and pests can be used to assess and resolve complex claims. 

He introduced the concept of thermal time, a method for calculating the development stages of temperature-dependent organisms, which is particularly useful in verifying pest life cycles in cases involving infestations. James also discussed the importance of proper grain storage practices, highlighting how failures in ventilation and moisture control can lead to spoilage, pest infestations, mould growth and even fires. 

The presentation included a case involving a fallen tree that damaged a listed building, where long-term fungal infection, failure to act on tree inspection results and lack of maintenance were key contributing factors. James emphasised the legal responsibilities of landowners in managing tree health in relation to public safety. 

Further examples covered marine cargo infestations, mould contamination in buildings, and crop damage, including a case where herbicide drift (the unintentional movement of herbicide droplets or vapor through the air to nontarget areas,) led to disease infection. He also examined a claim involving potato damage in storage, where incorrect application of a growth regulator led to widespread spoilage, and liability was traced to the contractor. 

Through these case studies, James demonstrated how an expert plant pathologist, using the latest scientific tools and techniques, can provide insurers and loss adjusters answers to causation and liability, and support fair outcomes in claims involving biological and environmental factors. 

James is a Senior Associate at Hawkins, based in the Reigate office. He specialises in plant pathology, cargo spoilage, and contamination investigations. He has managed diagnostic plant clinics for UK and international clients, and previously held research roles at Rothamsted Research, Stockbridge Technology Centre, and Berry Gardens Growers. His work spans crop failures, pesticide damage, wildfires, mould outbreaks, and marine cargo issues.  

James holds a BSc in Biological Sciences from Brunel University and is a member of several professional bodies, including the Royal Society of Biology, the British Society of Plant Pathology, and the International Society for Plant Pathology.
