Noise-related personal injury claims extend far beyond conventional claims for noise-induced hearing loss. Such matters often involve complex questions relating to exposure, causation, foreseeability, risk management and liability, requiring careful technical and evidential analysis.
In this webinar, Ros Lambert-Porter will examine the investigation of occupational noise-induced hearing loss, including the assessment of exposure histories, workplace controls, hearing protection provisions and audiometric evidence. The session will also explore acoustic shock arising from sudden or unexpected sound incidents, including consideration of the Grindleford Criteria and their application when distinguishing acoustic shock from alternative medical or psychological explanations.
Ros will conclude by considering incidents where individuals fail to hear alarms, warning signals, reversing alarms, or shouted instructions. These cases can arise from excessive background noise, hearing impairment, inappropriate hearing protection, poor acoustic environments or inadequately designed warning systems.
Drawing on practical examples and forensic investigations, the session will highlight the evidential challenges involved in establishing causation and liability, together with the competing duties and responsibilities that may fall upon employers, contractors, equipment manufacturers and other parties.
